1. Acceptance of Terms

Welcome to Talking Buddy AI ("the App"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and yapAI Labs Artificial Intelligence Technologies Inc. ("Company", "we", "us", or "our").

By downloading, accessing, or using the App, you verify that you have read, understood, and agree to be bound by these Terms. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. AI Services & Safety Disclaimer

• Not a Real Person: The characters are generated by Artificial Intelligence. They do not have real feelings, consciousness, or independent agency.
• Accuracy & Hallucinations: AI may generate incorrect, fictional, or nonsensical information. You remain solely responsible for how you interpret and act on any information provided by the AI. Do not rely on the App for decisions that could result in financial loss, physical harm, or legal consequences.
• Safety Filters: We implement technical measures to reduce harmful content, but we cannot guarantee that the AI will never generate inappropriate outputs.

3. Age Requirements & Eligibility

To use the App, you must meet the minimum age requirements specified by the content rating of the App on the platform (e.g., Apple App Store or Google Play Store) from which you downloaded it.

• Age of Majority: If you meet the store's age rating but are still considered a minor in your jurisdiction (usually under 18), you represent that you have obtained your parent or legal guardian's permission to use the App and that they have agreed to these Terms on your behalf.
• Account Security: You are responsible for maintaining the security of your device and account credentials.

4. Subscriptions & Fair Use

• Billing: Payments are managed directly by Apple (App Store) or Google (Play Store). We do not store credit card details.
• Fair Use Policy: "Unlimited" features (such as text messaging) are subject to fair use. We reserve the right to apply reasonable technical limits (rate limiting) to prevent abuse, bots, or excessive usage that impacts service stability.
• Refunds: Refund requests must be directed to the respective App Store, as we do not have the ability to process refunds directly.
• Price Changes: If we make material changes to pricing, we will notify you via the App or store listing.

5. Prohibited Use

You agree not to use the App to generate or promote:

• Child sexual abuse material (CSAM), nudity, or sexually explicit content.
• Self-harm, suicide, or violence against others.
• Hate speech, harassment, or terrorist propaganda.
• Spam, automated queries, or bot-like activity.

We may suspend or terminate your access without notice if we detect or reasonably suspect such misuse.

6. Intellectual Property & Licenses

• App Content: The code, 3D models, design, and voice synthesis technologies are owned by yapAI Labs and are protected by copyright laws.
• Restrictions: You may not copy, modify, distribute, reverse engineer, decompile, or attempt to extract the source code of the App.
• User Content License: By sending messages to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and transmit that content solely for the purpose of operating, improving, and securing the service (e.g., generating AI responses). We do not use your personal chats to train our general public models beyond what is necessary for your personalized experience.

These Terms are governed by the laws of the Republic of Türkiye. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Courts of Ankara, Türkiye.

9. App Store Disclaimer

Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the App or its content. All claims related to billing or refunds must be addressed directly with the relevant app store.

10. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice within the App or via the app store listing. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.
